William C. Bollard has successfully mediated many dozens of cases, from matters involving two-party local disputes to international disputes involving multiple participants located around the world. Mr. Bollard is fluent in Spanish and routinely engages in cross-border disputes. As a dedicated mediator, he is fully committed to the process, as each and every matter is as unique as its participants. Mr. Bollard is a member of the California Association of Realtors Panel of Mediators. He regularly mediates disputes over real estate transactions including rescission claims, non-disclosure cases, partition cases and disputes over earnest money disposition. Mr. Bollard also mediates business litigation matters involving employment issues, partnership and corporate disputes, trade secrets and intellectual property rights claims. Having been trained at the Straus Institute for Dispute Resolution, Mr. Bollard brings more than 35 years of litigation experience to the disputes he mediates. Mr. Bollard is also a former panel member of the American Arbitration Association. With recent world-changing developments, Mr. Bollard has adapted his services to include virtual or Zoom mediations. Even with advanced technology, Mr. Bollard’s settlement rate of cases remains high.
Mr. Bollard is willing to provide a a brief review of the technical process during a “practice session” with any and all participants. In a remote mediation, separate breakout rooms are established to provide confidential settings to accommodate sensitive negotiations or for counsel to confer during the process. Additionally, our offices provide multiple conference rooms for small to large groups in the event an in-person mediation is desired.
Mr. Bollard endeavors to share separate, brief discussions with counsel and/or self-represented parties prior to mediation to review the process, general dispute, unique factors, party concerns and identification of key participants and documentation. As a neutral, third party, his role is to assist the parties to review their needs, issues and requests, seeking common ground and, ultimately, resolution. Because the process is completely voluntary, the parties (with their counsel) are the decision makers; Mr. Bollard simply paves the way forward so they may arrive at a resolution. In the unlikely event a matter does not resolve, he remains committed to the process, following-up at the parties’ request, with continued assistance.
